Launched on 14 June, Assets for Care is a new guide for lawyers produced by Seniors Rights Victoria (‘SRV’), to assist older clients at risk of financial abuse.

The focus of the guide, funded by the Victorian Legal Services Board, is situations where assets are transferred in exchange for care. Lawyers have a special role in the prevention of harm arising from these arrangements.

SRV recognises the complexity of obtaining legal redress for older people when they are left without adequate resources for retirement and with broken relationships with family members. The emotional upset involved often occurs in conjunction with serious health issues and trying to untangle arrangements entered into between parties can be fraught with difficulty.

The SRV Guide aims to help lawyers detect financial abuse, identify protective action, try to remedy abuse, recognise and deal with matters relating to a client’s vulnerability, and identify and avoid the pitfalls and risks.

The guide is available from www.seniorsrights.org.au, as a pdf or as web-based materials, or a hard copy can be obtained by calling 03 9655 2129.
